Ms. Bonaparte,

I am receipt of your email.  I believe you should continue to discuss the matter of ex parte communications with Ms. Susan DeMasters, Long Beach EEO Manager and Ms. Maya Soloway.  When a case reaches hearing, it is out of ORM’s jurisdiction.

If you feel that there are communications that are inappropriate, please notify counsel.

Greetings,

I am going through Maya Soloway,  Attornery for Long Beach VA “aka” Tibor Rubin Medical Center’s, information:

“First, it is inappropriate for you to have ex parte communications with the EEOC, i.e., neither party can contact the EEOC judge without including the other party. Your inclusion of the VA Director is not appropriate as I am the Agency Representative in connection with your current case, pending before the EEOC (Agency Case No. 200P-0600-2014102775; EEOC Case No. 480-2015-00201X). I am representing the Agency. Therefore, please include and/or contact me when communicating with the EEOC and in connection with your current EEO case. Second, your current EEO case pertains to an accepted claim pertaining to an April 28, 2014 reasonable accommodation request. I am not aware of any other accepted claims. Therefore, I am unclear as to why you are discussing other matters with the EEOC. If you have another pending case related to the matters addressed in your February 2, 2015 letter, please let me know immediately and provide information regarding that case”. [200P 0600 2017100709 awaiting hearing, judge to be assigned.

Okay, I thought we had another indivdual in which was up on our case, I understand Patricia Geffner, was Acting Reional Counsel, but who am I to speak with during these communications.

I am told, here at the VA Long Beach “aka” Tibor Rubin Medical Center – Herbert, Mosia, is gone. So who took his place. Or, is it advisable I contact you Ms. Sophia Eaves, Regional Counsel Director.

Because the Judge has change to Ms. Nancy Graham, we are in contact on the First two cases.
