A   Yeah. It’s Jeffrey Robert Arcaro.

Q Please state yes or no regarding whether or not you’ve engaged in prior EEO activity.

A   Yes

Q   Please state yes or no whether you possess a disability.

A   I do not have a disability. No

Q   And for the period November to December of 2016, what was your position, job title, grade level and series?

A   What’s the time frame again?

Q   November to December of 2016.

A   I was the Assistant Chief of Health Administration Service. And that is a GS – 301, 13.

Q   Thank you. And is that your current title and grade

A   It is.

Q   Okay. Please state your place of employment, including your work address, e-mail and telephone.

A  It’s VA Long Beach Healthcare System. The address is 5901 East Seventh Street, which is Long Beach, California.

Q   Thank you.   And for the same period, November to December of 2016, who were your first- and second-line supervisors, and what were their titles?

A   My first – line supervisor was the Chief of Health Administration Service, Pam Womack. And my second-line supervisor was the Associate Director of the hospital. And that is Ms. Jill Dietrich.

Q   And do you know Marie Sylvia Bonaparte, herein after referred to as the complainant? And if yes, what is your organizational relationship with her?

A   Yes, I do know Ms. Bonaparte. I would be her third-Level supervisor.

Q   Okay. Are you aware of whether or not the complainant is a qualified individual with a disability?

A   I am not familiar with her medical activity. I know that she wears a respirator to work every day. So my assumption would be she is disabled.

Q   Okay.

A   She also has a recurring intermittent Family Medical Leave case. And I do believe she is off every Wednesday for treatment of her medical condition.

Q   Okay. And how early did you become aware of that ? Was it prior to November 22nd, 2016?

A   It was shortly after I started in Long Beach, which was in August of 2015.

Q   Okay. And as of November 1st, 2016 were you aware of the complainant’s prior EEO activity?

A   I know the complainant had filed a number of EEO complaints regarding – I think she filed some against her Section Chief, which was Gisele Payne.

Q   Okay. And how did you become aware of that?

A   I think, for one, I was notified by the EEO Counselor here at the medical center, Ms. Susan DeMasters.

Q   Uh – huh.

A   And then I think I had heard that she had prior EEO activity before that.

Q   Okay. All right.

     I am going to get into the claims. The complainant alleges she was discriminated against based on reprisal and her disability when since on November 22nd, 2016, Ely Quesenberry has not granted her accommodation request to be reassigned to the Greater Los Angeles VA facility.

     So first, did you have any role or involvement in her request to be reassigned?

A   No. I had dealt with a request. I don’t know if it was the same request. I think there were two separate ones. And these were reasonable accommodation requests.

Q   Okay.

A   She had put forward a reasonable accommodation request – I would say this was – this probably took place in – I’m going to guess and say it’s roughly around April of 2016. It was over a year ago – where she had requested that she wanted a different office space because of the perfume scents and body odors that were – that were prevalent in her work area.

We were – we examined a number of options where she could be relocated, one of which was an area that was under construction that was not going to be suitable.

Another area that was leased to the Credit Union that would also not be viable office space for her. And then so the third option was another space that had no carpet that was actually across the hallway from her Section Chief, Gisele Payne.

And she declined that space because she stated that her Section Chief, Gisele Payne, wore too strong of perfume.

After that there was another reasonable accommodation request that was filed that had to do with requesting relocation to the Greater Los Angeles VA.

And at the service level, we did nothing with that. Because any kind of reassignment to another VA, you know, those are – reassignment to another location or reassignment to another job series, those are always facilitated at our facility by HR and not by the service line.

Q   Okay.

A   And I do believe from what I – I think I asked Ely Quesenberry –

Q   Uh – huh.

A   — you know, what the status was with that. And I do believe he told me that there was not adequate medical documentation that was provided that would say that – that would prove that, you know, another – another VA facility would be beneficial for her medical condition.

Q   Okay. And did you have any documents that you wanted to provide in support of your statement

       Today?

A     I do believe I could find in my e-mails when I made the decision on the reasonable accommodation

Request regarding the office change. I do believe that was signed by me. I’m fairly certain.

If you haven’t spoken with Ely Quesendberry, he would probably have the — he would have the –he would have the version that I signed and he signed. The only version that I have is the one that I signed.

Individual – in the Executive levels are being looked at, why, and during the same time not allowing employees to speak out and feel not bulled by their Supervisor, Supervisory, Manager, Management, Sector Chief, Chief & Assistant Chiefs.

Interesting New, was informed that the documentation sent to the hospital is being, reviewed to his finding.

Drilling / Construction is underneath OP=247, out and around the location.

In walking, through the waiting room a patient became sick, and the husband / caregiver gabs a trashcan.

What was more – disturbing is look at the Clerk in the area, looking at me as to what it is I was going to do, and did not assist at the aid of Patient Seating in her own lobby.

Continued with the assist by, retrieving paper towel from the bathroom / and lay a VA towel over her lap where some of the fluid landed.

Nurse wonderful Nurse Karen had her Door closed, heard what was going on assisted with clean-up and pushed the patient, down to the Emergency Room to continue her Care.

See if the clerk, had a back ground as a nurse’s Aide, or Healthcare worker she wouldn’t have minded getting her Hands Soled to help the Veteran keep her dignity.

So, she came in clean clothes, but had to Leave are hospital with soled ones.

Then noted as before blog, I explained how Executives Manager have the ability in which to control and view your computers while you’re up on them.

I had used the information a business Manager had ligated for the Executive Chief at the time:

–ACCESS Creation, which authorization by Executive Management for OVER / COMP time to work down the backlog and address all clerical errors.

Interesting Day, [7/6/17] would come in to find most individual are still on a vacation / camping/ single visiting with their children.

In listen some they’re still on the roads or flying in the sky, for changes and relaxation.

Still, seeing the heavy clinic would possible need help, but the Supervisory nurse here are not sending them to other location in which to Assist or help.

A She’s Assistant – no. She’s the Section Chief.

Q And who does she report to?

A She reports to Jeff Acaro, who is the Assistant Chief

A Yes.

And do you know Ms. Bonaparte, hereinafter referred to as the complainant? And if so, what is your organizational relationship to her?

A I’m her immediate supervisor.

Q Okay. Are you aware if the complainant is a qualified individual with a disability?

A Yes.

Q Okay. What are you aware of in terms of her disability?

A She needs to be in a dust-free area. She needs to be where there’s no carpet, where there is no service dog in the area. Nobody with perfume can be around her. Or any type of deodorant.

Q And do you know specifically what her disability is?

A No. I don’t know exactly what it is.

Q Okay.

A I’m just told what her restrictions are.

Q Right. Okay. Did she ever provide you documentation that relates to her disability?

A Not to me directly. No.

Q Okay. Were you aware that she had a disability as early as December 9th, 2016?

A Yes.

Q Okay. And how did you become aware?

A Again, I was told about the restrictions that I had to adhere to for her.

Q   Okay. And who informed you of that? Was it the Reasonable Accommodation Coordinator or someone else?

A It was Gisele Payne.

Q Oh. Okay. Were you aware of the complainant’s prior EEO activity as of December 9th 2016? And if yes, when and how did you become aware?

A No.

Q And did you become aware after December 9th, 2016?

A Yes.

Q Okay. And how?

A I got a letter through the EEO stating that she had a complaint regarding her accommodation.

Q And was that informing you of this complaint?

A No.

Q Okay. So do you recall when that was?

A It was about two months ago maybe. Three months ago.

Q Okay. Okay. So moving on to the claims, the complainant alleges she was discriminated against based on reprisal and disability when on December 9th 2016, she alleges that you denied her request for leave for December 5th, 6th, and 8th of 2016.

           So were you involved in this incident?

   And if so, was any other management member involved?

A I was involved in that. And we did clear that up. She kept insisting that she did not get it, and she did. She was give that – that leave.

Q Okay. What kind of leave did she request?

A Let me pull it up. That was December the 5th; correct?

Q Right. 5th, 6th, and 8th

A Okay. She requested annual leave in lieu of sick on the 5th, the 6th. On the 8th she requested FMLA. And then let’s see. Okay. Yeah. I’m sorry. On the 8th she requested annual leave in lieu of sick.

Q Okay. And was her request granted or denied?

A The 5th, and the 6th and the 8th, they were all approved.

Q Okay. Excuse me. I’m sorry. And it looks like based on an e-mail that I was provided with a file — I h–e and em-mail here from you to the complainant. I’m just going to read it for you. It says:

       “This is to reiterate the phone message I left for you on

         December 8th. As I stated, you called in on December 5th, 6th, and 8th.

         Each time you called in between 6 a.m. and left a message reflecting sick leave, which you have exhausted. Ms. Bonaparte, you need to speak with me. There is no one in the call center until 7:30. I tried to return your call, but it went to your voice message. You also need to bring documentation from your doctor on your return.”

         So was her initial requested for sick leave, and later she changed it to annual leave in lieu of sick?

A Correct

Q   Okay. Did you initially deny her sick leave because she had exhausted all of her sick?

A   Right.

Q   Okay. Understood.

A   Right.

Q   Did she ever bring in documentation from her doctor to support her absence?

A   No.

Q Was that not necessary once she used annual leave in lieu of sick?

A That’s correct.

Q Did you take this action in order to treat the complainant any differently or less favorably than other employees due to her disability status or prior EEO activity?

A No. It’s the same standard procedure. They need to call. When they call out sick, they need to call at a time when we’re here. They cannot call at 6:00 in Morning, because there’s nobody here at 6:00 in the morning.

Q Uh-Huh.

A And they usually leave a number for us to return the call, which we return. And we’ll speak to them and see what’s going on, if they do need (inaudible). But she never responded.

Q Okay. Was the complainant later informed that she was approved for annual leave in lieu of sick?

A Yes. Because she had to go back in and request it.

Q I see. Okay. So she had to do that in the system. And she did it, and then you approved it?

A Correct

Q   Okay. Did she ever tell you that she disagreed with your actions during this incident?

A   No, she didn’t

Q Okay. Do you know if she complained to any other member of management?

A Not that I’m aware of.

Q Okay. Are there any other employees that report to you since you’ve been supervisor that requested sick leave that was denied?

A Yes. We do have – I do have other employees that if they have don’t have the sick leave, it’s denied. And they can go ahead and ask for annual leave instead.

A And we approve it.

A So they are able to do that.

A I have – they’re agents that work under me

  1. Yes. She has asthma that is triggered by airborne irritants. She has a permanent restriction of not working in carpeted areas. Ms. Bonaparte told me about her disability and work restrictions but I don’t recall the approximate date. On March 2,2017, she provide me with medical documentation dated February 28, 2017 from Judson Schoendor, MD (Attachment #1). On March 16,2017, she provided me with medical noted dated March 15, 2017 from Ghan Lohiya, MD (Attachment #2).

  1. Yes. Ms. Bonaparte mentioned to me she made a previous complaint to EEO but I do not recall when she told me.

  1. I am the Local Reasonable Accommodation Coordinator for the VA Long Beach Medical Center (March 2015 to present). My role is to facilitate the reasonable accommodation process.

(Ava) Pamela Womack, Chief, Health Administration Service

 

Was Complainant able to perform the essential functions of the position with

    or without an accommodation?

  1. Yes.

 

Did Complainant request an accommodation? What accommodation, if any, did Complainant suggest and when?

  1. Ms. Bonaparte requested to be transferred to another VA facility, West Los Angeles on or about November 7, 2016 (Attachment #3).Ms. Bonaparte requested for management to relocate her to another office on or about February 8, 2016 (Attachment #4)Ms. Bonaparte requested to telework and /or have tour of duty change on or about July 21, 2014 (Attachment #5)

What action did the agency take to identify possible accommodation or attempt accommodation? Did the agency make an individualized assessment of Complainant, comparing his qualifications and limitations with the job requirements? What actions did the agency take to consider Complainant’s suggested accommodations?

 

  1. In identifying a possible accommodation for the request dated November 7, 2017, and to make an individualized assessment of comparing her qualifications and limitations, the Agency sent an e-mail to Ms. Bonaparte on December 2, 2016 (Attachment #6). The e-mail requested for Ms. Bonaparte to submit medical documentation to support how the current location is not effective when performing the essential functions of her position.
  2. On April 10,2017, Assistant Chief, HAS, Jeffrey Arcaro created Work Order # HV170410-003 and to check overheard ceiling vent for location bldg. 126A-OP247. As result of the checking the vent, there was no sign of chemical. The work order was closed on April 26,2017 (Attachment #8).

 

Did the agency provide an accommodation? If yes, when? If an accommodation was identified, would the accommodation enable Complainant to perform the essential functions of the job, i.e., is it effective?

 

  1. Regarding Ms. Bonaparte’s reasonable accommodation request dated November 7, 2016, a determination has not been made. The medical documentation submitted by Ms. Bonaparte did not support how the current location is not effective when performing the essential functions of her position and why GLA is an effective reasonable accommodation.
  2. Regarding the accommodation request dated July 21, 2014, the designated management, Mary Ann Child (Retired), provided Ms. Bonaparte with an alternate accommodation to minimize environmental allergens. She was granted approval to wear a sealed respiratory mask. An HEPA air filter was issued to Ms. Bonaparte for her private office. An air quality study was conducted and air ducts in areas she was assigned to work were cleaned. VA staff was reminded to avoid using/wearing strong scents in the workplace. In addition, her work schedule was modified to allow her to seek medical treatment. She was allowed to take “fresh air” breaks in addition to existing 15 minute breaks. Communication was modified by reducing face to face contact through the use of telephone and electronic communication (Attachment #5).

     

    If the agency did not provide an accommodation, what reason has the agency given for its refusal?

    1. The agency has not refused to provide an accommodation. The agency has requested for Ms Bonaparte to submit medical documentation to support how the current location (bldg.. 126, OP-247) of accommodation is not effective when performing the essential functions of her position and why GLA is an effective reasonable accommodation. Ms. Bonaparte’s current work location, Bldg. 126A-OP247 allows her to perform the essential duties as a Medical Support Assistant.On May 26,2017, Ms. Bonaparte submitted additional medical documentation dated April 26, 2017 from Ghan Lohiya MD, and it is currently being reviewed (Attachment #9).

    If you took the action that is claimed to have been discriminatory (failed to great Complainant’s accommodation request to be re-assigned to the Greater Los Angeles VA facility), did you take that action in order to treat the complainant any differently or less favorably than other employees because of her, disability status or prior EEO activity? If no, please explain WHY you took this action.

    1. The Agency has not taken action that is claimed to have been discriminatory.

    What is the agency’s policy regarding reasonable accommodation requests?

    Was the policy followed in Complainant’s case?

    1. The Agency policy is listed in VA HANDBOOK 5975.1 (Attachment #10). Yes. The policy was followed in this case.

VA accountability is essential to making sure that our veterans are treated with the respect they have so richly earned through their blood, sweat and tears.

This law will finally give the VA Secretary – who is, by the way, just doing some job, and he’s doing it with this and with the heart. (Applause.)

It gives the Secretary the authority to  remove federal employees who fail and endanger our veterans – and to do so quickly and effectively. It’s been a long time since you’ve heard those words. Those entrusted with the sacred duty of serving our veterans will be held accountable for the care they provide.  It’s a big statement.

At the same time, this bill protects whistleblowers who do the right thing.

We want to reward, cherish, and promote the many dedicated employees at the VA.

This legislation also gives the VA Secretary the authority to appoint new medical directors at VA hospitals – something which was almost impossible to do in the past.

And these are going to be talented, talented people.

This has been a wonderful Saturday of adventure, and happiness.
The housekeeper, who are willing to work the extra hours in which to beautify the
facility, can now count on the pay in which to live in pride.
One the works stated ” the directors levels questing [WHY] the money- setting their” it need to be used in which to cleaning up”, looking, now stairs on the outer, building from head to bottoms. Only ones that use the stairs for cardio’s, and circulation of the blood would enjoy the cleanses of the stair wells.
 
 
After hour security for Firer Watch is in place.
That is needed – with all the Construction going on an rounded our VA Long Beach “aka” Tibor Rubin Medical Center’s Campus.
The glass, medals; stones, window’s. In being the creative skilled thinking person, I can vision the butterfly’s hanging, as in the breast cancer lobbies.
What about the small humming birds, outside the screens you see each day in which to remind you, everything is okay.
Well it would seem I am one visionary looking to see the finishing project, including the fencing which should have been up year and year ago.
Saturday’s clinic are becoming very helpful to the patients who’s able to keep their appointments on the weekend’s without disrupting your week.
 
As a result, I would need to wait and see what the list of decision. Can the basics the director is choosing to place, use the additional creative minds.

Okay, I am back, and it would seem some interesting things were said about the infrastructure of the divisions, through the hospital.

Still, waiting to see how the information will be sent for those who missed the Town Hall Meeting 6/21/17.

The newly, VistA, outlooks, system were applied to sort computer by not ALL.

The Skype / IM , system is pretty cool, because it will provide the same, but look as those you’ll be able to skype with other workers.

In just a couple of weeks or so CHAMPVA, is possible no more, the veteran of our passes spouse / partner will be response for finding their care.

Some clinic area can provide extension, to their care according to doctor recommendations.

For a Thursday the clinic are slow, on all area of the floors. I observed the clerks cleaning up their last notes of the day.

The nurses of our, [Transitions Center, Mental Health, and Compensation &Pension, are/connect trying to call back the patients which are needed.

Thank God it is Friday, with John Gray in the heavens sending down his worded it has just been, wonderful.

I am still having to walk clear to the back of Campus [South to the North] in which to collect the projects / task of the months (days, and weeks).

This has been a week of rushing to complete paper works for both the Long Beach VA “aka” Tibor Rubin Medical Center.

It was stated during the Environmental Walks through the area on Monday that sort Print Room’s would be Locked therefore we would have to use the one’s out in the open areas.

My question is if this is to be SO, place the Badger Lock onto them, Not Key access [ money saver, we have to many key’s floating around here as it is], or even have individual place in the last four of

Their social security numbers, ya there is a thought.

I have place in a response to the Director Team , so we can read of listen to what has accrued during the Town Hall meeting. Then, those were interested in placing a input can.

I am hoping the N V A C, in Los Vegas, team comes back with some wonderful ideas on how to keep better tracks of the Venting, Heating, and Air System’s -GOOD LUCK.

The Long Beach VA “aka” Tibor Rubin Medical Center, still hasn’t present a Venting Report / they are not projected here, and so the doctor’s will not be able to present a correct Disability Report as Requested by Human Resource Department (HR) Long Beach VA “aka” Tibor Rubin Medical Center.

The Housekeeper Services, staff is here making round a foreman, checking the different rooms as nursing staff de-keys each one [“why don’t you all have your own KEY’s].

Sorry doctor that not how it’s done here at this hospital.

As a result, housekeeper, Lee, would need to STOP spraying the solution to the floor and using these micro mop’s they are leave a flame to the floor’s and it gets all up in your shoes. It end up in our floors at home, mate in the cars, and for those who seat with their leg crossed in the bottom of your pants. NASTY.. Please, help housekeeper to understand clean water, it should be changed after mopping, three to four room ONLY., depend on the dirt.

Finally, I know some people a busy during the weeks and let things go until next week or the weekends, at least clean, your work area, dust and organize. It will help you be more creative, print the vision in which you would like to have your Director’s be proud.

Creative: ask you worker underneath you, what do you think [DO NOT TAKE ALL THE CREDIT FOR YOURSELF].

For the worker given, there suggest, write them down- so you’ll remember and step up For Your Full Credit, remember you’re the one making them look good, especially if they are bold to ASK.

I did even notice anyone acknowledging this special day in when the salves were Free. Their freedom was a Big Mark in History to the Black community of domestic work in the mid 1800’s thereof.

I guess, in the words around the hospital, facility, of the Long Beach VA “aka” Tibor Rubin Medical Center, if the liquidation of Health Administration Service (HAS) is dependently happening.

The individual worker, are with head in the down word matter today. It like what is wrong now, did you and your’s have a wonderful father day. Be happy!

I went to collect, the project of the Day, to find M. Sargent did in deed present E. Minero with the chain of emails in which assist me in moving forward in completing “V S E” systems, and now just waiting for titled floors to come available in which to complete my course ahead of time.

The chemical are in it highest flow, in which the represented, was able to detect as well during her visit today.

Noted, the Silver Box shields in which some sort of flow system is being check according to Governmental status / policy/ rule and corrects.

The Director assembled a large, environment team in which to go around and check all room’s (@09:54hr) according, in which the police was present to open the doors if need be. Interesting how some area became very protective of their spaces, and questioning to what going on. Our new doctors were not recognized with this sort of processing and had to question the Medical Support Assistance.

GREAT, maybe in the near future, with the changes here at the LBVA, we can have a list of what it is the environmental team is looking.

It would seem the IRON fencing is going to take longer, in getting placed around the campus grounds.

I am not seeing where a gate would go on the seventh street entry, or the Bellflowers side.

Patient flow in the waiting room area for Compensations & Pension, Transition and Care Management Services (TCM), and mental health is moving better.

You can tell also, because it has been a while since patients have had to complain about leaving Voicemail on a nurse’s line and No Return phone calls.

The patients have smiles, of joy, peace upon their faces, etc.Finally the Long Beach VA “aka” hasn’t presented the document of changes.

I assume, all will have to wait until Wednesday 21st of June 2017 in for the Director to make his plan to the hospital. As a result G. Payne, Sector Chief did provide hard copies for use to have on the new wording of clinics.
